Section 1 - Access and Account
By using our website or services, you represent that you are at least the age of majority in your province, territory, state, or country of residence, or that you are the age of majority and have given consent for any minor dependants to use our website or services.
To browse our store or place an order, you may be asked to provide certain information, including your name, email address, billing address, shipping address, and payment information. You represent and warrant that all information you provide is accurate, current, and complete, and that you have the right to provide it.
You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. You must not transfer, sell, assign, or license your account to another person.
We may refuse service, close accounts, cancel orders, or restrict access to our website where we reasonably believe there has been fraud, abuse, illegal activity, misuse of our services, or a violation of these Terms.
Section 2 - Our Products
The Odd Goose Corp. sells print-on-demand apparel and related products online. Products are produced after an order is placed and may be manufactured, printed, packed, or shipped by third-party production and fulfilment partners.
We make reasonable efforts to display product colours, images, descriptions, sizes, prices, and availability accurately. However, product images may appear differently depending on your device, screen settings, lighting, and browser. Minor variations in colour, placement, print appearance, or product finish may occur as part of the print-on-demand production process.
Product descriptions, materials, sizing information, and care instructions are provided for general guidance. You are responsible for reviewing product details, size charts, shipping information, and order information before completing your purchase.
We may change, discontinue, limit, or update products at any time without notice.
Section 3 - Orders
When you place an order, you are making an offer to purchase the selected products. We may accept or decline your order for any reason permitted by law, including if a product is unavailable, there is an error in pricing or product information, payment cannot be processed, shipping is unavailable to the address provided, or we suspect fraud or misuse.
After placing an order, you should receive an order confirmation by email. This confirmation does not guarantee acceptance of the order if an error, availability issue, payment issue, or other problem is identified.
Because our products are print-on-demand, production may begin shortly after an order is placed. Once production has started, changes or cancellations may not be possible.
You are responsible for ensuring that your shipping address, sizing selections, colour selections, product selections, and order details are correct before completing checkout.
Section 4 - Prices, Billing, and Taxes
Prices are shown in Canadian dollars unless otherwise stated. Where price ambiguity may affect customers outside Canada, prices should be understood as CAD.
Prices, discounts, promotions, shipping fees, taxes, and availability may change without notice. We reserve the right to correct pricing errors, product errors, or order errors, including after an order has been submitted, to the extent permitted by applicable law.
Applicable taxes, including GST/HST, provincial sales tax, and other required taxes, will be calculated and shown at checkout where required.
We aim to present prices and mandatory fees clearly before checkout. Shipping charges, taxes, and any other applicable charges will be disclosed before you complete your purchase.
You agree to provide current, complete, and accurate billing and payment information. Payments are processed through Shopify and its payment service providers. We do not control all aspects of third-party payment processing and may rely on those providers to approve, decline, process, or refund payments.
Section 5 - Shipping and Delivery
The Odd Goose Corp. is an online-only business. We do not offer in-person shopping, local pickup, or physical-store services unless expressly stated on our website.
We currently ship to Canada and the United States, subject to shipping availability, carrier limitations, and any restrictions shown at checkout.
Delivery estimates are provided for convenience only and are not guaranteed. Print-on-demand products require production time before shipment. Production times and delivery times may vary due to order volume, product availability, carrier delays, customs processing, weather, holidays, incorrect address information, or events outside our reasonable control.
Risk of loss or damage to products passes to you when the order is delivered to the shipping address provided, except where applicable consumer protection laws provide otherwise.
You are responsible for providing a complete and accurate shipping address. We are not responsible for delays, failed delivery, or loss caused by incorrect or incomplete shipping information provided at checkout.
For shipments to the United States, you are responsible for any customs duties, import taxes, brokerage fees, or other charges that may apply, unless those charges are expressly included at checkout.
Section 6 - Returns, Exchanges, and Refunds
Returns, exchanges, refunds, and order issues are governed by our Refund Policy, which is incorporated into these Terms by reference.
Because our products are print-on-demand, returns or exchanges may be limited where a product was produced specifically for your order, unless the product arrives defective, damaged, incorrect, or otherwise eligible for a remedy under applicable law or our Refund Policy.
Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws.
If there is a problem with your order, contact us at hello@theoddgoose.com as soon as possible and include your order number, a description of the issue, and photos where relevant.
Section 7 - Accuracy, Completeness, and Timeliness of Information
We do our best to keep information on our website accurate, complete, and current. However, there may occasionally be typographical errors, inaccuracies, omissions, or outdated information relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, availability, or other content.
We reserve the right to correct errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate, to the extent permitted by applicable law.
Section 8 - Optional Tools and Third-Party Services
We may provide access to third-party tools, apps, integrations, payment services, shipping services, product production services, analytics tools, marketing tools, or other services that we do not own or control.
You acknowledge that third-party services may have their own terms, policies, privacy practices, fees, limitations, and availability. We are not responsible for third-party services except to the extent required by applicable law.
Your use of optional third-party tools or services is at your own discretion and risk.
Section 9 - Third-Party Links
Our website may contain links to third-party websites or resources. These links are provided for convenience only. We do not control, endorse, or assume responsibility for third-party websites, products, services, content, or policies.
You should review the terms and policies of any third-party website before using it or providing personal information.
Section 10 - Personal Information and Privacy
Your submission of personal information through our website is governed by our Privacy Policy.
By using our website or services, you acknowledge that personal information may be collected, used, stored, processed, or disclosed as described in our Privacy Policy, including by Shopify and other service providers used to operate the store, process payments, fulfil orders, provide customer support, and communicate with you.
Section 11 - Marketing Communications
If you sign up for marketing emails or other commercial electronic messages, we will handle those communications in accordance with Canada’s anti-spam legislation and other applicable laws.
You may unsubscribe from marketing communications using the unsubscribe link or instructions included in the message, or by contacting us at hello@theoddgoose.com.
Transactional or service-related messages, such as order confirmations, shipping updates, account notices, or customer service responses, may still be sent where permitted by law.
Section 12 - User Comments, Feedback, and Submissions
If you send us ideas, suggestions, reviews, comments, images, feedback, or other submissions, whether online, by email, through social media, or otherwise, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, edit, publish, translate, distribute, and display that content in connection with our business, marketing, website, products, and services, subject to applicable law and our Privacy Policy.
You represent that your submissions do not violate the rights of any third party, including intellectual property, privacy, publicity, or other rights. You must not submit unlawful, abusive, defamatory, obscene, misleading, or harmful content.
We may remove, edit, or decline to use submissions at our discretion.
Section 13 - Intellectual Property
All content on our website, including text, graphics, logos, product designs, images, photographs, artwork, icons, videos, page layouts, and software, is owned by or licensed to The Odd Goose Corp. or our licensors and is protected by copyright, trademark, and other intellectual property laws.
You may access and use our website for personal, non-commercial shopping purposes only. You must not copy, reproduce, modify, distribute, sell, exploit, scrape, or create derivative works from our website content, product designs, or brand assets without our prior written permission.
The Odd Goose name, branding, designs, and related marks may not be used without permission.
Section 14 - Prohibited Uses
You must not use our website, products, or services:
- for any unlawful purpose;
- to violate any applicable federal, provincial, territorial, state, local, or international law;
- to infringe our intellectual property rights or the rights of others;
- to submit false, misleading, abusive, defamatory, obscene, or harmful information;
- to harass, abuse, insult, harm, defame, intimidate, or discriminate against any person or group;
- to upload or transmit viruses, malware, or harmful code;

- to interfere with the security or operation of our website, store, payments, or services;
- to place fraudulent orders or misuse promotions, discounts, returns, refunds, or chargebacks;
- to scrape, crawl, automate, reverse engineer, or exploit any part of the website without permission.
We may suspend or terminate access to our website or services for any prohibited use.
Section 15 - Disclaimer of Warranties
Our website, services, and products are provided to the fullest extent permitted by applicable law.
Except as expressly stated by us or required by applicable law, we do not warrant that our website or services will be uninterrupted, timely, secure, error-free, or free from harmful components.
Except as expressly stated by us or required by applicable law, products and services are provided without warranties or conditions of any kind, whether express, implied, statutory, or otherwise, including implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties or conditions. In those jurisdictions, the exclusions apply only to the extent permitted by law.
Section 16 - Limitation of Liability
To the fullest extent permitted by applicable law, The Odd Goose Corp. and its directors, officers, employees, contractors, agents, service providers, suppliers, licensors, and affiliates will not be liable for any indirect, incidental, punitive, special, consequential, or exemplary damages, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages arising from your use of our website, services, or products.
To the fullest extent permitted by applicable law, our total liability for any claim relating to an order will not exceed the amount you paid for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded or limited under applicable consumer protection laws.
Section 17 - Canadian Consumer Protection Rights
Nothing in these Terms is intended to exclude, restrict, or modify any legal rights, warranties, conditions, remedies, or protections that cannot be excluded, restricted, or modified under applicable Canadian federal, provincial, or territorial consumer protection laws.
For Ontario consumers, this includes any non-waivable rights under Ontario consumer protection legislation, including rights relating to clear disclosure, correction of errors before purchase, delivery of required agreement information, cancellation rights where legally available, unfair practices, and remedies for goods or services that do not meet applicable legal requirements.
If any part of these Terms conflicts with a non-waivable consumer protection right, the consumer protection right will apply to the extent of the conflict.
Section 18 - Indemnification
You agree to indemnify, defend, and hold harmless The Odd Goose Corp. and its directors, officers, employees, contractors, agents, service providers, suppliers, licensors, and affiliates from any claim, demand, loss, liability, damage, cost, or expense, including reasonable legal fees, arising from your breach of these Terms, your misuse of our website or services, your violation of any law, or your violation of the rights of a third party.
This indemnity applies to the fullest extent permitted by applicable law.
Section 19 - Termination
These Terms remain in effect unless and until terminated by either you or us.
You may stop using our website or services at any time. We may suspend or terminate your access to our website or services if you breach these Terms or if we reasonably believe your use creates legal, operational, security, fraud, or reputational risk.
Any obligations or liabilities incurred before termination will survive termination. Sections that by their nature should survive termination will continue to apply, including sections relating to payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.
Section 20 - Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the maximum extent permitted by law, and the unenforceable portion will be deemed severed from these Terms. The remaining provisions will remain in full force and effect.
Section 21 - Entire Agreement
These Terms, together with any policies or operating rules posted by us on our website or referenced in these Terms, constitute the entire agreement between you and The Odd Goose Corp. regarding your use of our website, services, and products.
Any failure by us to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Section 22 - Governing Law
These Terms and any separate agreements under which we provide products or services to you are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Subject to any rights you may have under applicable consumer protection laws, you and The Odd Goose Corp. agree that the courts of Ontario will have jurisdiction over disputes arising from or relating to these Terms, our website, services, or products.

You do not need to consent to promotional text messages to make a purchase.
Message frequency may vary. Message and data rates may apply. You may unsubscribe from promotional SMS messages by following the instructions in the message, such as replying STOP where available.
We may still send transactional or service-related messages where permitted by law, including order updates, shipping notices, and customer service responses.
